Santa's Letters Terms and Conditions:
Definitions:
“Santa's Letters Offer” shall mean the offering of personalised free Santa's Letters and gift.
“Draw” shall mean the offering of a chance to win a Prize (based on a test of skill) as described in the Terms & Conditions.
“Participant(s)” shall mean any person/individual who takes part in the Draw by sending a relevant keyword or trigger to the Shortcode / completing several steps on a web-site advertised in connection with the Santa's Letters Offer and Draw.
“Winner(s)” shall mean any person/individual who has been awarded a Prize by Realm and who has passed the required skill test.
“Prize(s)” shall mean the item of value offered in advertising for the Draw. The definition and interpretation of Prize shall be strictly that defined by Realm, its Directors and agents and in the event that any ambiguity is found to exist in respect of the word Prize the final decision as to its actual meaning shall be made solely by Realm, its Directors and agents and any such definition shall be accepted by Winners without reservation.
“The Company” shall mean Realm Communications Ltd., the company which runs the Santa's Letters Offer and complimentary Draw.
Terms and Conditions:
Subscribers must ensure that their mobile phone is WAP enabled.
Participants must be 18 years of age or over to avail of the Santa's Letters Offer and Draw. Proof of age may be required to claim Prizes. Failure to provide proof of age within 7 days of being requested to do so may result in Santa's Letters and Prizes being permanently withheld.
Participants must provide The Company with an A4 sized Stamped Self-Addressed Envelope and the following details: your child's name, age, address and christmas wish and your mobile telephone number within seven days of receiving the informational texts on how to claim. Failure by the Participant to provide one or all of these may result in the Santa's Letters Offer being withheld.
It is a condition of entry to the Santa's Letters Offer and complimentary Draw that Winners shall allow their full names and addresses to be published by The Company , through any media, including SMS transmissions, along with details of the Prizes won.
Winners must pass a skill test in order to obtain Prizes. This shall usually (but not exclusively) consist of a general knowledge question or questions asked at the time of awarding the Prize.
The Prize shall be regarded as having been properly awarded if it is forwarded to the Winner within 28 days of the date of the Winner being selected. The Company accepts no responsibility for lost or damaged Prizes resulting from inaccurate or false contact details given by the Winner.
Certain categories of people are excluded from claiming Prizes. They are: any companies and individuals associated with The Company, or related companies or individuals, their families, friends and close acquaintances, including live-in partners. Also, contractors and/or sub-contractors, or persons directly supplying services in connection with, their families, friends and close acquaintances, including live-in partners.
The Directors of The Company reserve the right to permanently withhold Prizes from individuals whom they have reasonable grounds to suspect may be in breach of this exclusion.
The Company reserves the right to alter, suspend or terminate the complimentary Prize Draw at its discretion, and without notice.
Prizes shall only be awarded to Winners who provide their correct names, and contact information. It is the Winner's responsibility to ensure that such details are correct. The Company shall not accept responsibility for non-payment or non-awarding of Prizes due to an inability to process contact details provided by Winners. Prize amounts and types are subject to change without notice but The Company undertakes to maintain an equal or higher value to that of the individual wholesale cost of Prizes to The Company.
The Company shall endeavour to contact the prospective Winner within 7 working days of their allocation. However The Company shall not be held responsible for an inability to contact Winners or award Prizes due to circumstances outside its control.
Winners who accept Prizes agree, as a condition of entering the complimentary Draw, to take part and cooperate with any publicity event required to promote the Draw.
It is the Participant's responsibility to ensure that they are fully aware of and completely understand these Terms & Conditions. Participants who enter the Santa's Letters Offer and/or the complimentary Draw are confirming that they have read these Terms and Conditions, that they have understood them, and that they have agreed to be bound by them. These will be as described in the promotional text messages or in general advertising. Participants should note that using this service they will receive free promotional offers in the future in relation to Realm and its services. For more information call 0818 286606. The Draw is not open to Participants who do not accept these pre-conditions. However Participants have the right to opt out at any time free of charge by texting NOMORE to 0879259387. Child’s details collected will only be used for purpose of Santa letter fulfilment.
The Company may refuse to award Prizes, or may not honour Prizes already awarded, in the event that said Prizes were obtained as a direct or indirect result of fraud, dishonesty or non-entitlement to participate in the Draw and Santa's Letters Offer under the Terms & Conditions, or as a result of failure by the Winner/Participant to adhere to the Terms & Conditions specified herein. This condition shall also apply to Participants who obtain Prizes through the unlawful, and/or unauthorized use of a telephone (mobile or fixed line) of which they are not the registered owners and/or bill payers. In special circumstances, if so requested by the relevant Network Operators, and/or by ComReg, Prizes may be withheld pending the resolution of issues pertaining to unauthorized telephone usage.
To the fullest extent permitted by law, the Directors of The Company reserve the right to amend these Terms & Conditions, change, or terminate the Draw and Santa's Letters Offer at any time. Details of such amendments, changes or termination, shall be published and shall be applicable as from the date of such publication (publication shall also mean the transmission to relevant individuals of an SMS message).
It is the responsibility of the customer to inform The Company if they change / cancel their mobile telephone numbers. Entries must be received by 16th December & will be despatched by 19th December 2008.

To claim your Santa Letter and gift, send a SAE to Santa, PO Box 10243, Dublin 24. Please include the mobile number you used to enter this service, and the child’s name and Christmas wishes, so that we may personalise the letter.
Please ensure your entry is received before 14th December. Letters will be dispatched around 16th December 2009.
